These Terms & Conditions ("Terms") govern your use of Birdie Golf Carts websites, including birdiegolfcarts.com and all Birdie Golf Carts subdomains, location websites, booking pages, and forms that link to these Terms, including unity.birdiegolfcarts.com.

Our Privacy Policy explains how we collect and use personal information and forms part of your relationship with us when you use our sites.

2. About Birdie Golf Carts

Birdie Golf Carts provides golf cart sales, rentals, service, and related services through locations in Canada, the United Kingdom, and the United States. Our headquarters is at 970 Empire Road, Sherkston, ON, Canada L0S 1R0.

3. Use of our websites

You agree to use our websites only for lawful purposes and in a way that does not:

Violate applicable laws or regulations
Infringe the rights of Birdie Golf Carts or any third party
Attempt to gain unauthorized access to our systems or data
Introduce malware, spam, or automated scraping beyond normal browsing
Submit false, misleading, or fraudulent information through our forms

We may suspend or restrict access to our websites if we reasonably believe you have violated these Terms.

4. Rental and service requests

Reservation requests are not confirmed bookings

Golf cart reservation request forms on Sherkston and Unity resort sites are requests only. Submitting a form does not guarantee availability or create a confirmed reservation until our staff contact you and your booking is confirmed according to our rental process.

Location-specific rental rules

Each resort location has its own rental rules, FAQs, and policies posted on that location's website (including Rental Rules pages). By submitting a rental request or proceeding with a confirmed rental, you agree to comply with the applicable rules for that location, including but not limited to:

All drivers must be at least 25 years old with a valid driver's licence
Carts must remain within the property boundaries of the relevant resort
Late returns may incur fees as stated on each location's site
Deposit and cancellation terms as stated on the rental form or communicated by staff

For Sherkston and Unity, cancellation policies stated on the rental request pages apply. For example, golf cart deposits may become non-refundable within two weeks of the reservation date, as stated on those forms.

Pricing and availability

Prices, cart types, and availability displayed on our websites are subject to change without notice. Where a site states that prices for a future season are subject to change, that notice applies until updated pricing is confirmed by our staff.

5. Dealer services

Our dealer location websites (Port Colborne, Carleton Place, and Hamburg) provide information about inventory, parts and service, custom builds, event rentals, winter storage, and financing. Content on these sites is for general information and does not constitute a binding offer until confirmed in writing or through a separate agreement with Birdie Golf Carts.

Contact form submissions are enquiries only. We will respond as promptly as practicable during our published business hours.

6. Intellectual property

All content on Birdie Golf Carts websites — including text, logos, images, graphics, and design — is owned by or licensed to Birdie Golf Carts and protected by applicable intellectual property laws.

You may view and print pages for personal, non-commercial use. You may not copy, reproduce, modify, distribute, or exploit our content without our prior written consent.

7. Third-party links and services

Our websites may link to third-party services such as Instagram, TikTok, or other external sites. We are not responsible for the content, policies, or practices of third-party websites or services.

Location websites are hosted on third-party platforms. Your use of those platforms may also be subject to the platform provider's terms.

8. Disclaimers

Our websites and their content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Birdie Golf Carts makes no warranties, express or implied, regarding the accuracy, completeness, or availability of website content.

Information about inventory, pricing, rental availability, and services may change. Always confirm details with our staff before relying on website content for important decisions.

9. Limitation of liability

To the fullest extent permitted by applicable law, Birdie Golf Carts will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our websites, even if we have been advised of the possibility of such damages.

Our total liability for any claim relating to your use of our websites is limited to the amount you paid to us through that website in the twelve months before the claim, or CAD $100 if no payment was made, whichever is greater.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including mandatory consumer rights in your jurisdiction.

10. Indemnity

You agree to indemnify and hold harmless Birdie Golf Carts from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of our websites, your violation of these Terms, or your violation of any law or third-party rights.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that the courts of Ontario, Canada shall have exclusive jurisdiction over disputes arising from these Terms, except where mandatory consumer protection laws in your country of residence require otherwise.

If you access our websites from the United Kingdom or United States, you may have additional rights under local law that these Terms do not override.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of our websites after changes are posted constitutes acceptance of the updated Terms.
